Definitions

For the purposes of this document, the following definitions apply:

  • Personal Data – information concerning a natural person that identifies or enables the identification of that person, meaning that based on such information, the identity of the natural person concerned can be determined directly or indirectly.
  • Platform – all components constituting the website operating under the domain https://zfwsdlq904.edukacja.onl.
  • Processing – any operation or set of operations performed on Personal Data or on sets of Personal Data, whether or not by automated means, such as collection, recording, organization, structuring, storage, retrieval, consultation, or deletion.
  • Privacy and Cookie Policy/Privacy Policy – this document defining the rules for processing Personal Data through the Service and Platform in accordance with the GDPR.
  • GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons concerning the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation).
  • Website/Service – the website operated by the Administrator under the domain olgamakiewicz.pl.
  • User – a User or Client within the meaning of the Terms and Conditions, whose Personal Data is processed as part of the Service and contracts concluded through it.

General Information

The Privacy Policy has been prepared based on and in compliance with all GDPR requirements, particularly including all necessary information that the Administrator is obliged to provide to the person whose Personal Data is processed and from whom such Data is collected, based on Article 13 of the GDPR, ensuring fairness and transparency in Data Processing by the Administrator.

Capitalized terms not defined in this Privacy Policy shall have the meanings given to them in the Service’s Terms and Conditions, available on the Service’s website.

The Privacy Policy describes issues related to the Processing of Personal Data solely through the Service, including within the framework of contracts concluded remotely based on the information available on the Service’s website.

The Service website uses encrypted data transmission, meaning it possesses an SSL (Secure Sockets Layer) certificate, a network protocol used for secure internet connections.

The Administrator has not appointed a Data Protection Officer, as the small scope and scale of the processed Personal Data do not necessitate it in the Administrator’s assessment, nor is it legally required.

Scope of Processed Personal Data

Through the Service and Platform, the Administrator may process Personal Data via:

  • Placing Orders and concluding Distance Contracts via the Shopping Cart.
  • Analytical tools such as Google Analytics, Meta Pixel, TikTok Pixel.
  • Marketing tools such as Google Ads.
  • Fulfilling legal obligations arising from applicable laws, particularly accounting and tax regulations.

The Administrator may also process Personal Data in cases involving the establishment, exercise, or defense of claims in legal proceedings.

All Personal Data processed by the Administrator through the Service and Platform is provided voluntarily by the User.

The User is not required to provide their Personal Data to the Administrator, either directly (e.g., via an Order form) or indirectly (e.g., data collected via third-party cookies like Google Analytics). However, failure to provide certain Personal Data may result in the inability to perform a given service or achieve a specific goal (e.g., failure to provide Personal Data in the Order form prevents the User from placing an Order).

If the User provides their Personal Data, the Administrator will process it lawfully, adequately, and in a manner limited to what is necessary for the purposes for which it is processed, in accordance with the principle of data minimization outlined in the GDPR.

Specific legal bases for Processing Personal Data are indicated later in this Privacy Policy.

Processing of Personal Data for Digital Content Agreements

When concluding a Digital Content Agreement remotely via the Platform, the Administrator processes the necessary Personal Data to place an Order and conclude the Agreement, including name, surname, email address, phone number, bank account number, payment card number, and possibly NIP, company name, and registered business address.

The legal basis for processing Personal Data as part of placing an Order and concluding an Agreement is Article 6(1)(b) of the GDPR, meaning processing is necessary to take action at the User’s request before concluding a contract and to perform the contract to which the User is a party.

Personal Data processed in connection with an Order and Agreement is retained until the expiration of claims related to the Agreement, as determined by applicable law.

Processing of Personal Data via Analytical Tools

The Administrator uses analytical tools on the Service and Platform, including Google Analytics, Meta Pixel, and TikTok Pixel.

Through these tools, the Administrator may process Personal Data such as IP address, approximate location (limited to city), gender, and age.

The legal basis for Processing Personal Data under this section is Article 6(1)(a) of the GDPR, meaning processing based on the User’s consent for the purpose of using the analytical tools mentioned above.

The purpose of Processing Personal Data using Google Analytics, Meta Pixel, and TikTok Pixel is statistical analysis of User traffic on the Service and Platform, as well as User interaction with the Service, which enables the Administrator to optimize the website’s performance and conduct business effectively.

Users can give their consent for Personal Data Processing via the cookie consent banner displayed upon their first visit to the Service website. They can withdraw their consent at any time without affecting the lawfulness of processing carried out before the withdrawal.

Final Provisions

In matters not regulated by this Privacy Policy, applicable Polish law and the GDPR shall apply.

The Administrator reserves the right to amend the Privacy Policy, particularly when required due to changes in Personal Data Processing practices, technological developments, or legal changes related to matters described in this document.
